This document (General Sales Terms) defines the conditions applicable to distance sales through the website www.walab.it between Manuela Mazzucato and the buyer of the Products qualifying as a consumer (i.e., an individual acting for purposes unrelated to entrepreneurial, commercial, artisanal, or professional activities, hereinafter referred to as the "Customer").

General Provisions
- 1. The languages available for the Customer to conclude the contract through the website are English.
- 2. The Customer is required to carefully read the General Sales Terms provided by Wa Lab on the website to enable knowledge, storage, and reproduction.
- 3. Each order requires the full acceptance of these General Sales Terms. By placing the order, the Customer declares to have read the General Sales Terms available on the website and fully accepts them.
- 4. These General Sales Terms are drafted in English and apply only to Sales Contracts concluded through the website by Customers residing and indicating a delivery address currently in the following countries: Wordwide.
- 5. The website can be accessed from anywhere in the world. However, purchases by customers residing in the listed countries with a delivery address outside those countries are not allowed. Purchase requests from countries other than those listed will not be accepted.
- 6. The purchase of Products is intended exclusively for individuals qualified as consumers, i.e., individuals acting for purposes unrelated to their entrepreneurial, commercial, artisanal, or professional activities.
- 7. To make purchases through the website, the Customer must be of legal age (18 years) and have the capacity to act, which the Customer declares to possess.
- 8. The Customer is solely responsible for any expenses for Internet connection to the website, including telephone charges, according to the rates applied by the Customer's selected operator.
Products: Information and Availability
- 1. The presentation of Products on the website does not constitute an offer to the public but only an invitation for the Customer to make a contractual purchase proposal.
- 2. Information about the Products is provided on the website for each Product through textual and photographic content.
- 3. Photographic content is for the sole purpose of presenting the Products for sale. Since color aspects may not accurately represent the real Product, also due to the Customer's browser or monitor, Wa Lab does not guarantee an absolute match between the image on the website and the actual Product.
- 4. Products are sold with the features presented on the website at the time of placing the order by the Customer.
- 5. The availability or unavailability of Products is indicated on the website for each Product. The sale of Products is subject to availability as indicated on the website, and it will not be possible to proceed with the purchase of Products presented as unavailable on the website. Wa Lab is not responsible for searching and sourcing unavailable Products from other sources.
- 6. If, for any reason, Products already ordered by the customer are not available for sale, Wa Lab will promptly notify the Customer and refund any amount already paid by the Customer. In this case, Wa Lab is not obligated to deliver the ordered goods.
- 7. Wa Lab reserves the right to modify information regarding each Product, the assortment of Products on the website, and their availability at any time without notice.
Order
- 1. The order submitted by the Customer is considered a contractual proposal and implies the full and unconditional knowledge and acceptance of the General Sales Terms in effect at the time of the order.
- 2. Wa Lab reserves the right to modify these General Sales Terms at any time at its sole discretion and without notice. Any changes made will be considered valid from the date of publication on the website and will apply exclusively to orders placed after that date.
- 3. To proceed with the purchase of desired Products available for sale on the website, the Customer must add the selected Products to the virtual cart. The Customer can then choose to complete the purchase as a guest or as a registered customer.
- 4. For the first purchase (guest customer), the Customer must provide their details to complete the order and sales contract. During the purchase process, the Customer has the option to register, creating a personal account on the website.
- 5. In the case of a purchase as a registered customer, the Customer will log in to the website with their credentials before completing the purchase process.
- 6. To proceed with the purchase, the Customer must access the product detail page, either by clicking on the product image on the product list page or by using the search function. On the product detail page, the Customer will find information about the Product, including price, availability, and a description.
- 7. To add the Product to the cart, the Customer must click on the "Add to Cart" button.
- 8. After adding the Products to the cart, the Customer can view the cart, modify the quantity of the Products, and proceed to checkout.
- 9. During the checkout process, the Customer must provide the necessary information for the order, including billing address, shipping address, payment information, and any other information required to complete the order.
- 10. Before completing the order, the Customer will have the opportunity to review the order details, including the total price, and correct any errors or modify the order if necessary.
- 11. The order is considered placed when the Customer completes the checkout process by confirming the order and making the payment.
- 12. By placing the order, the Customer makes an irrevocable contractual proposal to purchase the selected Products.
Price
- 1. The prices of the Products are expressed in Euro (€) and include Value Added Tax (VAT) where applicable. Shipping costs are not included in the Product price and are calculated separately during the checkout process.
- 2. Wa Lab reserves the right to change the prices of Products at any time without notice. The prices applicable to each order are those in effect at the time the order is placed and indicated on the website. Any changes made after the order is placed will not affect that order.
- 3. The total price of the order, including the cost of the selected Products and shipping charges, is indicated on the order summary page before the Customer confirms the order.
- 4. In the event of an error in the display of the price or total price on the website, Wa Lab will inform the Customer as soon as possible and give the Customer the option to confirm the order at the correct price or cancel it. If Wa Lab is unable to contact the Customer, the order will be considered canceled, and any amounts already paid will be refunded.
Payment
- 1. The Customer can pay for the Products using the payment methods available on the website during the checkout process. The accepted payment methods may vary and are indicated on the website.
- 2. Payments are processed through secure and certified payment gateways. The Customer's payment information is encrypted and transmitted securely to the payment gateway.
- 3. The order will be processed and shipped only after the payment is successfully completed. In the event of payment failure or rejection, the order will not be processed.
- 4. Wa Lab reserves the right to refuse orders or shipments from customers who have outstanding payment issues or have not fully complied with these General Sales Terms.
Order Confirmation
- 1. After the order is successfully placed and payment is received, the Customer will receive an order confirmation email containing the order details, including the order number, Products purchased, total price, billing address, shipping address, and any other relevant information.
- 2. The order confirmation email is not an acceptance of the order but a confirmation that the order has been received.
- 3. Wa Lab reserves the right to refuse or cancel an order, even after the order confirmation email has been sent, for reasons such as non-availability of Products, payment issues, or violation of these General Sales Terms.
Shipping and Delivery
- 1. Wa Lab ships Products to the delivery address provided by the Customer during the checkout process. The delivery address cannot be changed after the order is placed.
- 2. Shipping costs are calculated based on the delivery address and the total weight of the Products in the order. Shipping costs are indicated separately during the checkout process and included in the total price of the order.
- 3. Wa Lab aims to process and ship orders promptly, subject to Product availability. The estimated delivery time is indicated during the checkout process and in the order confirmation email.
- 4. Wa Lab is not responsible for delays in delivery due to events beyond its reasonable control, including but not limited to strikes, natural disasters, and customs delays.
- 5. The risk of loss or damage to the Products passes to the Customer upon delivery. It is the Customer's responsibility to check the condition of the Products upon delivery and report any damage or defects to the courier immediately.
- 6. If the delivery is not successful due to the Customer's unavailability or refusal to accept the delivery, the Products will be returned to Wa Lab, and the Customer will be responsible for any additional shipping costs.
Right of Withdrawal
- 1. The Customer has the right to withdraw from the contract, without specifying the reason, within 14 days from the date of receipt of the Products.
- 2. To exercise the right of withdrawal, the Customer must notify Wa Lab of their decision to withdraw by sending an explicit declaration by email to walabpadova@gmail.com or by using the withdrawal form available on the website.
- 3. The Customer must return the Products to Wa Lab without undue delay and, in any case, within 14 days from the day on which the Customer communicated their withdrawal from the contract. The deadline is met if the Customer sends back the Products before the period of 14 days has expired.
- 4. The right of withdrawal is subject to the condition that the Products are returned in their original, unused, and undamaged condition, including all accessories, tags, and labels.
- 5. The Customer is responsible for the direct costs of returning the Products.
- 6. If the right of withdrawal is exercised in accordance with these General Sales Terms, Wa Lab will refund the Customer the full purchase price, including the original shipping costs, within 14 days from the date on which Wa Lab is informed of the Customer's decision to withdraw from the contract.
- 7. Wa Lab may withhold the refund until the Products are received or until the Customer provides proof of having returned the Products, whichever occurs earlier.
- 8. The refund will be made using the same payment method used by the Customer for the initial transaction, unless the Customer has expressly agreed otherwise. In any case, the Customer will not incur any fees as a result of the refund.
Legal Conformity Warranty
- 1. Wa Lab is responsible for any lack of conformity existing at the time of delivery of the Products.
- 2. The Customer has the right to have the Products brought into conformity, free of charge, through repair or replacement.
- 3. The Customer may request a reasonable price reduction or termination of the contract if the repair or replacement is impossible or excessively burdensome, Wa Lab has not repaired or replaced the Products within a reasonable time, or the replacement or repair previously carried out has caused significant inconvenience to the Customer.
- 4. The Customer must report any lack of conformity within 2 months from the date on which the defect was discovered. After this period, the Customer loses the right to rely on the lack of conformity.
- 5. The legal conformity warranty is not applicable in the event of misuse, negligence, or failure to follow the instructions provided by Wa Lab regarding the proper use, maintenance, and storage of the Products.
Liability
- 1. Wa Lab is not liable for any damage resulting from the use of the Products other than that provided for or intended by these General Sales Terms.
- 2. Wa Lab is not liable for any indirect or consequential damage, loss of profit, loss of opportunity, loss of production, loss of business, loss of data, or any other form of economic damage.
- 3. In any case, Wa Lab's liability is limited to the total amount paid by the Customer for the purchase of the Products giving rise to the damage.
Force Majeure
- 1. Wa Lab is not liable for any delay or failure to perform its obligations under these General Sales Terms if the delay or failure is due to causes beyond its reasonable control, including but not limited to strikes, lockouts, riots, civil unrest, wars, natural disasters, and other force majeure events.
- 2. Wa Lab will promptly notify the Customer of the occurrence of a force majeure event and take reasonable steps to minimize the consequences of the event.
Applicable Law and Dispute Resolution
- 1. These General Sales Terms are governed by Italian law.
- 2. Any dispute arising out of or in connection with these General Sales Terms, including disputes relating to their validity, interpretation, performance, or termination, shall be subject to the exclusive jurisdiction of the Italian courts.
Amendments
- 1. Wa Lab reserves the right to amend these General Sales Terms at any time.
- 2. The General Sales Terms applicable to each order are those in effect at the time the order is placed.
Final Provisions
- 1. If any provision of these General Sales Terms is found to be invalid or unenforceable, the remaining provisions shall remain valid and enforceable.
- 2. Wa Lab's failure to enforce any right or provision of these General Sales Terms shall not be considered a waiver of those rights.
By placing an order on the Wa Lab website, the Customer confirms that they have read, understood, and accepted these General Sales Terms.
